Spencer, IA (KICD)– The Spencer City Council set a public hearing on Monday night that will explore the possibility having eminent domain used to help get a new street built on the north side of town.
City Attorney Don Hemphill explained this process would give the city a way to move forward to obtain a piece of land 30 feet wide should continued discussions with nearby landowners fail.
While the resolution that passed with a five to one vote was only to set the hearing, Councilman Brian Balk made his voice clear that he is not in favor of even looking at eminent domain as a possible option.
The public hearing is scheduled to take place at the next regular City Council meeting on October 16th.
