Sibley, IA (KICD)– The City of Sibley has agreed to a settlement with man injured doing construction work in the community in 2018.
The case stems from an incident in which Victor Maldonado was sustained injuries from an electrical shock caused by a power line being too close to the building he was working to lower a metal downspout onto.
A judge originally threw the case out in 2021 citing Iowa’s Public Duty Doctrine forbids an individual from suing a government entity, but an appeal at the federal level overturned that ruling, allowing the lawsuit to continue.
Despite the City of Sibley agreeing to a 2.6 million dollar settlement, the city is not admitting to liability in the case. The payment will also not come from city funds, but from the Iowa Communities Assurance Pool.
