During the arrest, police recovered the missing items and discovered methamphetamine.
Jorge Ardany Ortega-Ortega, 29, formerly of Cherokee, was sentenced Tuesday, May 5, in Buena Vista County District Court after a jury previously found him guilty of homicide by vehicle – reckless driving, a Class C felony.
Storm Lake Police, Buena Vista County Sheriff and Pocahontas County Sheriff assisted.
Deputies located the driver at his home in Spencer the following day and confirmed he had been injured.
Separately, the child’s parents filed a civil lawsuit against McDaniel in July 2025, alleging negligence and misrepresentation
The incident occurred in Storm Lake while the victim was holding a child, leading to charges of Assault Causing Serious Injury and Child Endangerment.
The investigation was led by the Buena Vista County Sheriff’s Office, with Judge Carl Petersen ordering the sentences for all counts to run concurrently.
Court records show the charges stem from an earlier investigation that began in September 2025.
The Storm Lake Police Department has identified the man arrested on multiple arrests Saturday night.
